City of Cupertino Below Market Rate (BMR) Fund/CDBG Housing NOFA(PDF, 111KB)

The City of Cupertino releases an annual NOFA and RFP to request proposals for eligible projects. Funds are used to serve low- and/or moderate-income households located within the City of Cupertino jurisdiction limits.

RFP Application Information & Deadlines: The FY 2025-26 NOFA/RFP will be released in Fall 2024.

HOME Funds

The United States Department of Housing and Urban Development (HUD) provides federal funding for the Home Investment Partnerships Program ("HOME Program"), which supports a variety of affordable housing initiatives for low-income households. The City of Cupertino is part of the HOME Consortium administered by the County of Santa Clara. Interested developers can apply for available funds through Santa Clara County's "Request for Proposal" process. PLHA Funds

The Permanent Local Housing Allocation (PLHA) is a state funding source for housing-related projects and programs that assist in addressing the unmet housing needs of the local jurisdictions. The County of Santa Clara has established a PLHA Consortium and administers Cupertino’s annual allocation. Interested developers can apply directly through the County's “Request for Proposal” process for available PLHA funds. Housing Mitigation Manual

The City Council adopted the Housing Mitigation Fees (effective July 1, 2021) for both residential and non-residential uses. On July 02, 2024, the City Council adopted an updated version of the Below Market Rate (BMR) Housing Mitigation Program Procedural Manual (Housing Mitigation Manual)(PDF, 589KB) which establishes procedures to implement housing mitigation as required by the General Plan 2015-2022 Housing Element. This manual consists of two major components, Section One addressing the office and industrial mitigation and Section Two addressing residential housing mitigation.

Below Market Rate Admin Manual

On June 17, 2025, the City Council adopted an updated version of the Policy and Procedures Manual for Administering Deed Restricted Affordable Housing Units (BMR Manual)(PDF, 1MB) to include a BMR Anti-Displacement Policy for renters in expiring affordable units.
